These Terms of Service ("Terms") constitute a legally binding agreement between you and SciDraw ("Company," "we," "us," or "our") concerning your access to and use of the sci-draw.com website and our AI-powered scientific illustration services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into this agreement
- You will comply with all applicable laws and regulations
- All information you provide is accurate, current, and complete
To access certain features of the Service, you must register for an account by providing:
- Valid email address
- Secure password
- Required profile information
You may also register using third-party authentication services (Google, GitHub).
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your account information remains accurate and up-to-date
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- Your account remains inactive for an extended period
- We discontinue the Service
You may delete your account at any time through your account settings or by contacting us.
SciDraw provides an AI-powered platform for creating scientific illustrations, including:
- Prompt-Based Image Generation: Create images from text descriptions
- Sketch Redrawing: Transform hand-drawn sketches into professional illustrations
- Style Replication: Generate images based on reference images
- Templates: Pre-designed templates for various scientific illustration types
- Multi-Round Editing: Iteratively refine generated images through conversation
- Image Storage: Secure cloud storage for your generated images
We offer multiple subscription tiers:
- Free Plan: Limited features with restricted credits
- Personal Plan: Monthly or annual subscription with included credits
- Business Plan: Enhanced features and higher credit allowances
Current pricing is displayed on our pricing page and may be updated with reasonable notice.
- Payment Processing: All payments are processed securely through Stripe
- Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless canceled
- Billing Cycle: Charges occur on the same day of each billing period (monthly or annually)
- Price Changes: We will notify you at least 30 days before any price increases
- Payment Failure: If payment fails, we may suspend your account until payment is received
- Taxes: You are responsible for any applicable taxes, duties, or government fees
- Credit Allocation: Credits are allocated based on your subscription plan
- Credit Usage: Credits are consumed when using AI generation features
- Credit Expiration: Credits expire according to your plan terms (typically 30 days)
- Credit Packages: Additional credits can be purchased separately
- No Refunds: Unused credits are non-refundable
Subscription Cancellation:
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of the current billing period
- You will retain access to paid features until the end of the billing period
- No partial refunds for unused time in a billing period
Refund Policy:
- We offer refunds within 14 days of initial purchase if you have used less than 10% of your allocated credits
- Refunds for technical issues will be evaluated on a case-by-case basis
- Credit package purchases are non-refundable
- To request a refund, contact support@sci-draw.com with your order details
Chargebacks:
- Initiating a chargeback without contacting us first may result in account suspension
- Fraudulent chargebacks may result in permanent account termination
You may use the Service to:
- Create scientific illustrations for research, education, or publication
- Generate images for academic papers, presentations, and educational materials
- Develop visual content for scientific communication
- Store and manage your generated images
You may NOT use the Service to:
- Generate illegal, harmful, or offensive content
- Violate any applicable laws, regulations, or third-party rights
- Infringe on intellectual property rights of others
- Create content for fraudulent or deceptive purposes
- Generate content that promotes violence, hatred, or discrimination
- Attempt to reverse-engineer, hack, or disrupt the Service
- Share your account credentials with others
- Resell or redistribute generated images without proper licensing
- Scrape or automatically collect data from the Service
- Overwhelm the Service with excessive requests (API abuse)
- Use the Service to create content that violates academic integrity policies
- You are responsible for the prompts you submit to the AI
- Generated content must comply with ethical and legal standards
- We reserve the right to review and remove content that violates these Terms
The Service, including its design, features, code, and content, is owned by SciDraw and protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or create derivative works of the Service
- Use our trademarks or branding without permission
- Reverse-engineer or decompile any part of the Service
User Inputs:
You retain all rights to content you input into the Service (prompts, uploaded images, descriptions).
Generated Images:
- You own the generated images created through the Service
- You grant us a limited license to store, display, and process your images as necessary to provide the Service
- You may use generated images for any lawful purpose, including commercial use
- You are responsible for ensuring your use of generated images complies with applicable laws
License Grant:
By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:
- Store and process your inputs and generated images
- Use anonymized data for service improvement and AI training
- Display your content as necessary to provide the Service
- We may use anonymized, aggregated usage data to improve our AI models
- We will not use your personal information or identifiable content without consent
- You can opt-out of data usage for AI training by contacting us
The Service integrates with third-party services:
- Stripe: Payment processing (see Stripe's Terms and Privacy Policy)
- Google Gemini AI: Image generation and text processing
- Cloud Storage Providers: Image storage and delivery
Your use of third-party services is subject to their respective terms and policies. We are not responsible for third-party services.
- The Service is provided "as is" and "as available"
- We do not guarantee uninterrupted, timely, secure, or error-free service
- We may experience downtime for maintenance, updates, or technical issues
- We are not liable for any loss or damage resulting from service unavailability
We reserve the right to:
- Modify, suspend, or discontinue any feature of the Service
- Change pricing with 30 days' notice
- Update these Terms at any time
- Impose limits on features (e.g., generation limits, storage quotas)
We will make reasonable efforts to notify you of material changes.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability: Fitness for a particular purpose
- Accuracy: Accuracy or reliability of AI-generated content
- Non-Infringement: Generated content does not infringe third-party rights
- Security: Complete security or privacy of your data
- Availability: Uninterrupted or error-free operation
You acknowledge that:
- AI-generated images may have imperfections or inaccuracies
- The Service is a tool and you are responsible for final content verification
- We do not guarantee specific results or quality of generated images
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCIDRAW SHALL NOT BE LIABLE FOR:
- Loss of profits, revenue, or business opportunities
- Loss of data or content
- Cost of substitute services
- Indirect, incidental, special, consequential, or punitive damages
- Damages arising from service interruptions or errors
- Damages resulting from unauthorized access to your account
Our total liability to you for all claims arising from your use of the Service shall not exceed the greater of:
- $100 USD, or
- The amount you paid us in the 12 months preceding the claim
Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless SciDraw, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of third parties
- Content you submit, generate, or share through the Service
- Your breach of any applicable laws or regulations
These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.
Before filing a claim, you agree to contact us at support@sci-draw.com to seek informal resolution. We will attempt to resolve disputes in good faith.
Any dispute arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except that:
- You may assert claims in small claims court if they qualify
- Either party may seek injunctive relief in court for intellectual property infringement
Class Action Waiver:
You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.
Some jurisdictions do not allow arbitration agreements. If you are in such a jurisdiction, this arbitration provision does not apply to you.
These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and SciDraw.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.
We are not liable for delays or failures due to circumstances beyond our reasonable control.
Provisions that by their nature should survive termination (including intellectual property, liability, and dispute resolution) will survive.
We may update these Terms from time to time. Material changes will be notified by:
- Email notification to your registered email address
- Prominent notice on the Service
- Update to the "Last Updated" date
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
